 note = {P(論文), いわゆるエネルギー転換を背景に、送電網整備が急がれるドイツでは、整備事業を具体化していく計画プロセスにおいて、自然環境や生態系へいかに配慮すべきかをめぐる議論が高まっている。多段階から成る計画プロセスの性質などから、最終的な事業許可に先立って、迅速化法に基づき送電線路の大まかな経路を決定するための連邦個別計画の策定段階で、切迫した整備需要と自然環境利益の保全との折り合いのつけ方がとりわけ問題となる。本稿は、この連邦個別計画の策定段階で、連邦自然保護法に基づく生息地保護・種の保存法といった自然保護の仕組みがどのように位置づけられるのか、そして、近年の学説における議論の所在を明らかにする。, The Energiewende requires large-scale expansion of energy grid in Germany. It is often disputed about how to give adequate considerations for the natural environmental or ecological effects of projects through the planning process. In the process, a route of corridors will be determined in the Federal Sectoral Planning before planning approval, by the Bundesnetzagentur according to the Grid Expansion Act（2011）. Mainly focusing on this step, this Article describes the ecological conservation mechanism through the planning, in the connection with some rules based on Federal Nature Conservation Act（2009）, for example for species protection and habitat conservation.},
