| 内容記述 | 2020年4月に，香川県は子供のゲーム時間などを制限することを内容に含む条例を施行した。その背景には，「ゲーム障害」を病気と して位置づけ，ゲーム依存症対策を行うべきだとする動きがある。ゲームやインターネットをすること，スマートフォンの利用などは本来 人々にとって自由とされるものであるはずで，それを制限することは憲法上問題があるともいえる。香川県条例はそうした自由を制限する 内容を含むもので，憲法上このような条例制定が認められるか疑問が残る。そのような中で施行された香川県の条例について，他の人権を 制約する可能性のある条例との比較を通じて，香川県条例の憲法適合性について検討する。 |

| 内容記述 | In April 2020, Kagawa Prefecture enforced the ordinance that contained restriction on video game times for children. Behind that, there is a movement to position “game disorder” as an illness and shall be take measures against game addiction. Playing video games, using the Internet, and using smartphones are the freedom of the people, and limiting them is a constitutional problem. The Kagawa Prefectural Ordinance includes content that limits such freedom, and it is questionable whether such an Ordinance will be permitted under the Constitution of Japan. I consider the Constitutionality of the Kagawa Prefectural Ordinance through comparing it with other ordinances that may restrict human rights. | |||||||||
